1. About Us
1.1 - “M6 Giraffe” (“we”, “us”, “our”) is a trading name of South Planks Limited, a company registered in England and Wales under company number 12168681 with a registered office at: South Planks Farm, Garstang Road, Barton, Preston, PR3 5AB

1.3 - These Terms govern your access to and use of the M6 Giraffe website (the “Site”), services, business listings, advertising opportunities, promotional content, and any related features or applications (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, you should not use the Services.
1.4 - M6 Giraffe operates as an online discovery and advertising platform featuring businesses, promotions, offers, experiences, and related content. Businesses (“Advertisers”) may purchase advertising placements, featured listings, sponsorships, or promotional visibility on the platform. Consumers (“Users”) may browse Listings and click through to third-party advertiser websites or offers.
2. Age Restrictions
2.1 - You must be at least 18 years old to use the Services or purchase advertising. By using the Services, you confirm that you meet this requirement.
3. Business Listings & Advertising (Advertisers)
3.1 - Advertisers may purchase advertising placements, featured listings, sponsorships, category placements, homepage visibility, promotional campaigns, or related services. Availability and placement are subject to editorial review and platform suitability.
3.2 - We reserve the absolute right, at our sole discretion, to:
- Approve or reject any advertisement or listing
- Request amendments prior to publication
- Remove or suspend content at any time
- Refuse content that may damage the reputation, integrity, or operation of the platform
We are not required to provide reasons for rejection.
3.3 - Advertisers must not submit content that:
- Is false, misleading, deceptive, or fraudulent
- Breaches UK advertising laws or regulations
- Violates the CAP Code or ASA guidance
- Contains offensive, defamatory, hateful, discriminatory, or obscene material
- Infringes intellectual property rights
- Promotes illegal products or services
- Contains malicious software, harmful links, or scams
We reserve the right to remove prohibited content immediately without notice.
3.4 - Advertisers retain ownership of their submitted content but grant M6 Giraffe a worldwide, non-exclusive, royalty-free licence to:
- Display
- Publish
- Reproduce
- Resize
- Optimise
- Promote their content in connection with the Services and related marketing.
Advertisers confirm they own or have permission to use all submitted content.
3.5 - We may track clicks, impressions, engagement, and related analytics anonymously for reporting and internal purposes. We do not guarantee:
- Traffic volumes
- Leads
- Sales
- Search rankings
- Enquiries
- Advertising performance
3.6 - Advertising fees are billed in advance unless otherwise agreed. Payments may be processed via Stripe or other approved payment providers. Where recurring billing applies:
- Payments may automatically renew each billing cycle
- Advertisers authorise recurring payment collection
- Failed payments may result in suspension or removal of Listings
3.7 - Cancellation & Refunds - unless otherwise agreed in writing:
- Advertising agreements have a minimum term of 3 monthly billing cycles. You agree to pay for at least 3 monthly payments. After the minimum term, your agreement continues on a monthly basis until you cancel by emailing info@m6giraffe.com
- Refunds are not provided for partially used periods
- Refunds are not available once advertising content has gone live
- Nothing in these Terms affects statutory consumer rights under UK law.
4. Compliance with Advertising Laws
4.1 - Advertisers are solely responsible for ensuring that all advertisements, promotions, pricing claims, and marketing materials comply with:
- UK advertising laws
- The CAP Code
- ASA guidance
- Consumer Protection from Unfair Trading Regulations 2008
- Any applicable sector-specific regulations
4.2 - M6 Giraffe acts solely as a publishing platform and does not independently verify legal compliance of submitted advertising claims.
5. User Conduct
5.1 - You must not:
- Use the Services unlawfully
- Upload harmful code or malware
- Scrape or data-mine the Site
- Attempt unauthorised access to systems
- Impersonate another person or business
- Submit false or misleading information
5.2 - We reserve the right to restrict or remove access where misuse occurs.
6. Intellectual Property
6.1 - All Site content, branding, graphics, design, code, and materials (excluding advertiser content) are owned by or licensed to M6 Giraffe.
6.2 - You may not reproduce, copy, distribute, or commercially exploit our intellectual property without written permission.
6.3 - “M6 Giraffe” and related branding may not be used without permission.
7. Data Protection & Privacy
7.1 - Our Privacy Policy governs how we collect and process personal data.
7.2 - We process data in accordance with:
- UK GDPR
- Data Protection Act 2018
- PECR regulations where applicable
7.3 - Advertisers are responsible for ensuring they lawfully collect and process any personal data connected to their promotions or websites.

8.1 - We use cookies and analytics technologies to improve the Services and measure platform usage.

9. Disclaimers
9.1 - The Services are provided “as is” and “as available”.
9.2 - We make no guarantees regarding:
- Availability
- Uptime
- Listing accuracy
- Business performance
- Advertising outcomes
9.3 - We are not a party to transactions between Users and Advertisers. Any purchases, bookings, or arrangements are made directly with the Advertiser.
10. Limitation of Liability
10.1 - To the maximum extent permitted by law, M6 Giraffe shall not be liable for:
- Indirect or consequential losses
- Loss of profits
- Loss of business opportunity
- Reputational damage
- Data loss
- Website downtime
- Reduced advertising performance
10.2 - Our total liability arising from the Services shall not exceed the total fees paid by the Advertiser in the previous 12 months; or £100 where no fees have been paid whichever is greater.
10.3 - Nothing excludes liability for:
- Fraud
- Death or personal injury caused by negligence
- Any liability that cannot legally be excluded
11. Indemnity
11.1 - Advertisers agree to indemnify and hold harmless M6 Giraffe, Apprian Limited, and their directors, employees, contractors, and affiliates against claims, losses, damages, liabilities, costs, or legal expenses arising from:
- Breach of these Terms
- Illegal or misleading advertisements
- Intellectual property infringement
- Regulatory breaches
- Consumer complaints relating to advertisements
12. Suspension & Termination
12.1 - We may suspend or terminate access to the Services immediately where:
- These Terms are breached
- Payment is overdue
- Content becomes unlawful or misleading
- Continued publication may expose us to legal or reputational risk
12.2 - You may stop using the Services at any time.
13. Changes to Terms or Services
13.1 - We may amend these Terms or modify the Services at any time.
13.2 - Updated Terms become effective upon publication on the Site. Continued use of the Services constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
14.1 - These Terms are governed by the laws of England and Wales.
14.2 - Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Miscellaneous
15.1 - These Terms constitute the entire agreement between the parties regarding use of the Services.
15.2 - If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
15.3 - Failure to enforce any provision shall not constitute a waiver.
15.4 - We may assign or transfer our rights and obligations under these Terms.
15.5 - No third party has rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.
